Terms of Use
Last updated: October 13, 2026
These Terms of Use (“Terms”) are an agreement between you and Alicia Labossiere, an independent app developer in Winnipeg, Manitoba (“Ayemel”, “we”, “us”). They cover the website ayemel.co (the “Site”) and the iOS apps Budget by Ayemel, Glow by Ayemel and Planner by Ayemel (the “Apps”), including TestFlight beta versions. By using the Site or the Apps, you agree to these Terms and to our Privacy Policy.
1. Who can use the Apps
You must be 13 or older to use the Apps. If you’re under 18, we suggest you talk with a parent or guardian before using the Apps (especially Glow by Ayemel) and read these Terms together. You also need a compatible Apple device and Apple ID.
2. Apple’s terms also apply
The Apps are distributed through Apple’s App Store and TestFlight. Your use is also governed by Apple’s Media Services Terms and Conditions and, unless we provide our own end user licence agreement, Apple’s Licensed Application End User License Agreement. If these Terms conflict with Apple’s terms on how the App Store works, Apple’s terms apply to that point.
You acknowledge that these Terms are between you and us, not Apple. Apple isn’t responsible for the Apps or their content, has no obligation to provide maintenance or support, and isn’t responsible for claims relating to the Apps (including product liability, legal or regulatory compliance, or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
3. Licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use the Apps on Apple devices you own or control, as permitted by Apple’s Usage Rules. You may not copy, modify, reverse-engineer, resell or redistribute the Apps, or use them for any unlawful purpose.
4. Free trial, subscriptions and lifetime purchases
Pricing (in Canadian dollars): the same pricing applies to all three Apps (Budget by Ayemel, Glow by Ayemel and Planner by Ayemel). Each App offers a 30-day free trial, then:
- CA$2.99 per month,
- CA$29.99 per year, or
- CA$59.99 one-time for lifetime access.
The 30-day free trial is Apple’s introductory offer on the monthly and yearly plans. You pick a plan when you start the trial. There’s no trial on the lifetime purchase. Prices may vary by country and may include taxes. We may change prices; Apple will notify you of increases to an existing subscription as its rules require.
Billing: all payments are processed by Apple and charged to your Apple ID. Payment is charged when the trial ends unless you cancel at least 24 hours before it ends.
Auto-renewal: monthly and yearly subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Any unused portion of a free trial ends when you buy a subscription.
Cancelling: manage or cancel in your iPhone Settings › your name › Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period.
Lifetime: a lifetime purchase gives access to that App’s paid features for as long as we offer the App and it remains available on the App Store, on devices signed in to the Apple ID used to buy it. It’s a one-time purchase and doesn’t renew.
Refunds: because Apple handles billing, we can’t issue refunds directly. Request a refund from Apple at reportaproblem.apple.com. Nothing in these Terms limits any refund rights you have under consumer protection law.
Restore purchases: use Restore Purchases in the App’s Settings to restore a purchase on a new device.
After a trial or subscription ends: you can always export your data, with or without a plan.
Partner sharing in Budget: one Budget by Ayemel subscription covers two partners sharing a budget. If the relationship ends, the person who bought the subscription keeps it.
5. Beta (TestFlight) versions
Beta versions are pre-release software. They may have bugs, lose data or change without notice, and may expire. Please back up important information. Your use of TestFlight is also subject to Apple’s TestFlight terms.
6. Your data
Your App data belongs to you. The Apps store it on your device and/or in your own iCloud account (Glow by Ayemel keeps its data on your iPhone only), not on our servers, so you are responsible for your device, Apple ID and backups. We can’t recover data that’s deleted, lost with a device, or removed from iCloud. See the Privacy Policy for details.
7. Not medical, financial or professional advice
Glow by Ayemel is for general wellness and personal tracking. It is not a medical device, is not intended for contraception or to prevent or plan pregnancy, and doesn’t diagnose, treat or prevent any condition. Cycle and fertility predictions are estimates. Medication reminders are scheduled on your iPhone and may not go off (for example, if notifications are off, the device is off or Focus is on); don’t rely on them as your only reminder. Nourish shows calories and nutrients from the bundled Canadian Nutrient File and from Open Food Facts, a third-party database. Values are estimates and may be incomplete or wrong, and calorie goals are optional. Nutrition and fitness information is general only and isn’t dietary or medical advice. If you have an eating disorder or a medical condition, or you’re pregnant, speak to a health professional before tracking calories or changing your diet. Always talk to a qualified health professional about your health, and call 911 in an emergency.
Budget by Ayemel is a budgeting tool. It doesn’t provide financial, tax, investment or legal advice. Figures such as interest calculations are estimates based on what you enter; check important figures with your financial institution.
Planner by Ayemel relies on Apple Calendar, Apple Reminders and your device’s notifications. We’re not responsible for missed events or reminders.
8. Feedback and the feature board
If you send us ideas, feedback or bug reports, you give us permission to use them to improve our products without paying you or crediting you. We may post approved ideas on the public feature board without your name or email. Don’t submit anything unlawful, offensive, or that you don’t have the right to share, and please don’t include sensitive personal information. We may edit or remove submissions at our discretion.
9. Site use
Don’t misuse the Site — for example, by trying to break its security, scraping it, sending spam through its forms, or uploading malware. We may block access for misuse.
10. Intellectual property
The Apps, the Site and their content — including the Ayemel name, logos, app icons, designs and text — belong to us or our licensors and are protected by law. These Terms don’t give you any rights to them except the licence in section 3.
11. Disclaimers
To the extent permitted by law, the Apps and Site are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Apps will be uninterrupted, error-free or meet every need. If an App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (Apple has no other warranty obligation). Some provinces don’t allow certain warranty exclusions, so some of these may not apply to you.
12. Limitation of liability
To the extent permitted by law, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Apps or Site. Our total liability for any claim is limited to the greater of the amount you paid for the App in the 12 months before the claim or CA$50. Nothing in these Terms limits liability that can’t be limited by law, or your rights under consumer protection law.
13. Indemnity
To the extent permitted by law, you agree to cover our reasonable losses arising from your breach of these Terms or misuse of the Apps or Site.
14. Product claims and support
We, not Apple, are responsible for addressing any claims relating to the Apps, including product liability claims, claims that the Apps fail to meet legal or regulatory requirements, and consumer protection claims. Contact us with questions, complaints or claims at the addresses below. In the event of a third-party claim that an App infringes intellectual property rights, we, not Apple, are responsible for investigating and resolving it.
15. Export and legal compliance
You confirm that you’re not located in a country subject to a Canadian or U.S. government embargo, and that you’re not on any government list of prohibited or restricted parties.
16. Changes and ending these Terms
We may update these Terms. We’ll change the date above and, for significant changes, give notice on the Site or in the Apps. Continuing to use the Apps after changes take effect means you accept them. You can stop using the Apps at any time by deleting them (and cancelling any subscription through Apple). We may suspend or end access if you seriously breach these Terms.
17. Governing law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there. You may bring claims in the courts of that province, or where consumer law gives you the right, in the courts of your own province.
18. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term isn’t a waiver. You may not transfer these Terms; we may transfer them to a successor.
